Form 4473: Electronic Processing Requirements Under ATF Ruling 2016-2
What is ATF Ruling 2016-2?
ATF Ruling 2016-2 authorizes FFLs to use electronic systems to complete ATF Form 4473 (Firearms Transaction Record). Combined with ATF Ruling 2022-01, which permits electronic storage and retention, dealers can now process the entire 4473 workflow digitally.
The Four Sections of Form 4473
Section A: Firearms Description
Lists the firearm(s) being transferred — manufacturer/importer, model, serial number, type, and caliber/gauge. Up to 5 firearms per form. For Privately Made Firearms (PMFs), the PMF designation must be recorded per Final Rule 2021R-05F.
Section B: Transferee/Buyer Information
The buyer completes this section with personal information, identification, and answers to 14 eligibility questions (Questions 21.a through 21.n). These include questions about actual buyer status, felony convictions, domestic violence, drug use, mental health adjudications, and immigration status.
Critical requirement: Once the buyer certifies Section B, it must be permanently locked. The buyer's answers cannot be modified after certification — this is a core compliance requirement of Ruling 2016-2.
Section C: Background Check (NICS)
The dealer records the NICS background check results — method (NICS, State POC, or NICS Exemption), transaction number, status (Proceed, Delayed, Denied), and date.
Section D: FFL Certification
The dealer certifies the transaction with their FFL information, signature, and date. Completing Section D finalizes the form.
Forever Retention
Under ATF Final Rule 2021R-05F (effective August 24, 2022), all Form 4473 records — including voided and denied forms — must be retained for the life of the FFL. There is no longer a 20-year expiration for 4473 records.
